Terms and Conditions

Company details

These terms and conditions are drawn up in accordance with the Consumer Protection Act (ZVPot), based on the recommendations of the Chamber of Commerce and Industry of Slovenia (GZS) and international codes for e-commerce.

Service description

Body in Motion offers services in the areas of:

• Personal coaching and sports training
• Nutrition counseling and planning
• Body measurements (body composition, anthropometry)
• Sleep and recovery optimization
• Data-driven progress tracking (Garmin, Withings)
• Project management and strategic consulting for organizations and schools

All services are provided by prior arrangement with the client, at locations in Murska Sobota and Maribor or remotely (online coaching).

Booking and execution of services

Appointments are booked by phone, email or WhatsApp message. An appointment is confirmed when the client receives written confirmation from the company.

In case of cancellation, the client must notify the company at least 24 hours before the agreed appointment. Late cancellation or no-show will be charged the full service price.

After submitting an enquiry or reservation, the client receives a summary of the agreement at the provided email address. Up to two hours after receiving the confirmation, the client may withdraw from or amend the agreement without consequence by sending a message to info@bodyinmotion.io or calling the company's phone number.

Prices and payment

All prices are in EUR. As the company is not VAT registered, prices do not include VAT. Prices are valid at the time of booking or conclusion of the agreement.

The following payment methods are available:

• Bank transfer to IBAN SI56 0284 3026 6201 063 (NLB d.d.)
• Cash (at in-person meeting)
• By prior arrangement with other payment methods

Service packages (e.g. monthly or comprehensive programme) are paid in advance before delivery begins. The client receives an invoice via email or at a personal meeting.

Contract withdrawal and refund

The client may withdraw from the contract for a service package within 14 days of conclusion, provided the service has not yet been delivered. Withdrawal must be communicated in writing to info@bodyinmotion.io.

For already completed services (completed training sessions, measurements, or consultations) withdrawal from the contract is not possible.

Upon valid withdrawal, the company refunds within 14 days from receiving the withdrawal notice, to the client's bank account.

Withdrawal from the contract is not possible for:

• Services that have been fully delivered with client consent
• Custom-ordered services (individually tailored program)
• Gift vouchers after activation

Liability

The client undertakes to inform the trainer before starting or advisory process informed the trainer of any health issues, injuries, chronic diseases or limitations, that could affect the safety of service delivery.

The company is not liable for injuries that arise from:

• Concealment of health conditions or injuries
• Failure to follow trainer instructions during and after training
• Performing exercises independently in an incorrect manner

The company strives for quality and safe delivery of all services and operates in accordance with applicable legislation and professional standards in the fields of sport and nutrition.

Personal data protection

The company protects client personal data in accordance with the GDPR and applicable personal data protection legislation.

Personal data (name, email, phone number, health-related information) is collected and processed exclusively for:

• Delivery of agreed services
• Communication with the client
• Sending invoices and confirmations
• Progress tracking (with explicit client consent)

Data will not be shared with unauthorized third parties. The client has the right to access, correct, delete, and transfer their data. Send your request to info@bodyinmotion.io.

The client may unsubscribe from promotional messages at any time.

Communication and promotions

Email and SMS messages are clearly marked as commercial or promotional, and the sender is always identifiable.

The conditions for campaigns, promotions, and the use of promotional codes are clearly defined. Promotional codes and discounts apply only to marked services and cannot be exchanged for cash.

The company reserves the right to change prices and terms without prior notice, while existing confirmed reservations remain valid under the originally agreed terms.

Out-of-court dispute resolution

The company strives to resolve any disputes amicably in in good faith. In case of a dispute, please contact us at info@bodyinmotion.io.

The company does not recognize external providers of out-of-court consumer dispute resolution as a mandatory authority. Access to the Online Consumer Dispute Resolution (ODR) platform is available at: https://ec.europa.eu/consumers/odr.
